Terms of service

I. General Information and Seller Details

The online store Dessert Boutique, operating at dessertboutique.pl, is run by the sole proprietor:

Vladyslav Mykolaichuk, conducting business under the name Dessert Boutique Vladyslav Mykolaichuk, registered in the Central Register and Information on Economic Activity (CEIDG).

II. Placing and Processing Orders

1. The store conducts online sales of confectionery products.
2. Orders may be placed 24 hours a day, 7 days a week via the website.
3. Placing an order constitutes acceptance of these Terms and Conditions and all related policies (including delivery rules and the privacy policy).
4. Order confirmation: An order is accepted for processing once:

• Payment has been recorded in the system (prepayment required), or
• In the case of business customers: after email confirmation and data verification (with the possibility of deferred payment) or full payment.

5. Failure to complete payment within the required time results in automatic cancellation of the order.

III. Prices and Payments

1. All prices listed on the website are gross prices (including VAT) and are stated in Polish złoty (PLN).
2. The price displayed at the time of placing the order is binding. Delivery costs are added according to the pricing listed in the “Delivery” section.
3. Payment methods: We accept electronic bank transfers and traditional bank transfers. Cash on delivery is not available due to the nature of the products.

IV. Changes, Withdrawal, and Cancellations

1. Order changes: Any changes to an order (such as details, flavor, or delivery time) must be reported by phone or email within 60 minutes of placing the order (between 10:00 and 19:00). After this time, changes may not be possible.
2. Product characteristics: Confectionery products and flowers are perishable and often personalized. In accordance with applicable law, the right of withdrawal is limited.
3. Order cancellation: Withdrawal from the contract is possible only within 60 minutes of purchase. In other cases, each request is reviewed individually via the store’s contact number.

V. Product Disclaimers

1. Artisan nature: All cakes and desserts are handmade. Minor differences compared to product photos (decorations, seasonal fruits, cream shade) are acceptable.
2. Weight tolerance: An acceptable weight variance of ±20% applies.
3. Ingredient availability: If a specific ingredient is unavailable (e.g. seasonal fruits or decorative flowers), Dessert Boutique reserves the right to substitute it with an alternative of the same quality and color while maintaining the character of the product.
4. In exceptional situations (e.g. equipment failure or ingredient shortages), the store may propose a product replacement or cancel the order with a full refund within 7 business days.

VI. Delivery and Pickup

1. Lead times: We offer fulfillment within 24 hours (for orders paid by 13:00), 48 hours, or 72 hours, depending on the complexity of the product.
2. Delivery times: Provided delivery times are approximate. Delivery at an exact minute cannot be guaranteed.
3. Delivery procedure:

• The courier may contact the recipient by phone.
• If the recipient is unavailable, the courier may leave the order with another person at the address or at reception/secretariat (in offices or hospitals).
• If delivery is unsuccessful due to absence and lack of contact, the product will be returned to the bakery. A second delivery is subject to an additional fee.

4. The customer is responsible for providing the correct delivery address.

VII. Complaints and Liability

The Customer has the right to submit a complaint regarding purchased products or provided services, in accordance with these Terms and Conditions.

A complaint may be submitted:

• electronically via e-mail to: dessertboutique.wroclaw@gmail.com,
• by phone at: +48 517 605 917,
• or in writing to the Seller’s registered address: ul. Św. Mikołaja 43/1, 50-136 Wrocław, Poland.

The complaint should include at least:

• the Customer’s full name,
• contact details (e-mail address or phone number),
• order number,
• description of the reason for the complaint.

Complaints regarding delivery delays should be submitted by e-mail within 48 hours of the scheduled delivery date.

Complaints regarding product quality (defects) should be submitted immediately after they are discovered, by phone or electronically.

Complaints are reviewed within 14 calendar days from the date of receipt.
The Customer will be informed of the decision electronically or by phone.

The Store shall not be liable for any deterioration in product quality resulting from improper storage by the Customer (e.g. lack of appropriate refrigeration after delivery).

The liability of Dessert Boutique is limited to the total value of the order, unless mandatory provisions of law provide otherwise.

VIII. Relationship with Shopify

1. Dessert Boutique is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Dessert Boutique.
2. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Dessert Boutique, including any injury, damage, or loss resulting from purchased products and services.
3. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Dessert Boutique.

IX. Data Protection and Final Provisions

1. The controller of personal data is Dessert Boutique and Dessert Boutique Vladyslav Mykolaichuk. Personal data is processed solely for order fulfillment and, with consent, for marketing purposes.
2. All materials published on the website are the property of the company.
3. The store reserves the right to amend these Terms and Conditions. Changes apply to orders placed after the publication date of the updated version.
4. Matters not regulated herein are governed by Polish law, including the Act on the Provision of Electronic Services.
